While a motion to dismiss focuses on allegations, a motion for summary judgment is all about evidence. In entering a dismissal with prejudice, a judge has determined that the complaint’s flaws are insurmountable and conclusively dismisses the case with no opportunity for the plaintiff to refile. In most cases where a motion to dismiss is granted, the judge will grant it without prejudice. A dismissal without prejudice means the plaintiff may be able to fix the shortcomings of the initial complaint by filing an amended complaint, and the court is giving the plaintiff the chance to do just that. In effect, the judge looks at all the allegations and concludes, “So what?”Ī dismissal can be either with or without prejudice. In the event the defendant includes facts or documents outside the complaint, the court is required to convert the motion to a motion for summary judgment.Ī judge will grant a motion to dismiss if those facts don’t or couldn’t form the basis of a legal action, even if the complaint’s allegations were true.
